Pension Valuations

In certain cases involving older plaintiffs or decedents who belonged to a specific defined benefit pension plan and would have continued to participate in that pension plan, and for whom we can obtain pension documentation, we calculate the loss of pension benefits separately (for a detailed explanation, see C.L. Brown, Damages: Estimating Pecuniary Loss (Toronto, Ontario: Canada Law Book, a Thomson Reuters business), 2011, chapter 2, section 2.8.e.). Pension losses can be substantial. In 2010, Ms. Brown's evidence was accepted by the Alberta Human Rights Tribunal to assess Ms. Walsh's Mobil Oil pension benefits (instead of an actuary's calculation). Ms. Brown testified in Jensen v. Thompson (2002) on Ms. Jensen's loss of federal government pension benefits, and she was awarded $56,265 for her pension benefits loss.
